Notice of Public Hearing

 

The Arkansas Department of Health & Human Services, Division of Health, will hold a public hearing on June 29, 2007, at 2:00 PM, in the Division of Health Room L137, 4815 West Markham Street, Little Rock, Arkansas, to allow interested persons to comment on the proposed adoption of "Rules & Regulations Pertaining to Public Water Systems", pursuant to Act 96 of 1913 (ACA 20-7-109).

 

Copies of the proposed Rules & Regulations will be available for public inspection and copying at the Engineering Section, Division of Health, 4815 West Markham Street, Little Rock, Arkansas.  The document is also available on the internet Here.

 

The public may submit written comments to:  Robert Hart, P.E., Director, Engineering Section, Division of Health, Department of Health & Human Services, P. O. Box 1437, Slot H-37, Little Rock, AR 72203-1437, so that the comments are received no later than 4:30 PM on June 29, 2007.

 

 

 

Proposed changes to the

“Rules & Regulations Pertaining to Public Water Systems”

 

Purpose For Revisions:

 

1.) Obtain authority to implement increased annual fees for public water systems as authorized by Act 292 of 2007.

XXV.ANNUAL FEES

The annual fees for public water systems provided for in Arkansas Statutes § 20-28-101 et seq are established at $0.30 per service connection per month for community and nontransient noncommunity water systems, with a minimum fee of $250.00; and at $125.00 for transient noncommunity water systems.

 

Comments: Act 292 of 2007 authorized an increase in the annual fees for public water systems.  The amount of the service connection fee is to be established by the Board of Health up to the maximum set in the statute and is the basis for this regulation change.  The proposed fee increase will be a nickel per service connection per month (from the existing $0.25 per service connection per month to $0.30) for community and nontransient non-community water systems, with the minimum fee increased from the existing $200 to $250.  It will also increase the annual fee for transient noncommunity water systems from the existing $100 to $125.  These fees were last raised in 1993.

2.)  Obtain a new approval date on the regulations to adopt by reference the EPA Ground Water Rule which was promulgated on November 8, 2006 (40 CFR Parts 9, 141, and 142.) and the Unregulated Contaminant Monitoring Rule 2 promulgated on January 4, 2007 (40 CFR Parts 9, 141, and 142).
